AJINGA PRIVACY POLICY


INTRODUCTION
The mission of AJINGA is to build China’s future by matching talent with opportunity. To achieve our mission, we make services available through our website and our mobile applications, to help our candidate users (“Candidate Users”) find opportunities, and to help our organization users (“Organization Users”, and together with Candidate Users, “Users” and each a “User”) find the right candidates for their open opportunities, and assess existing team members for selection or development. For Candidate Users, being part of AJINGA means sharing information about yourself with companies and communicating with them. By default, your account is set up to share information for the purposes of being considered for employment. The amount and type of information you decide to share, with potential employers or other parties, including outside the AJINGA platform, is up to you.
There are the three main types of information on AJINGA platform:
Information About Yourself that You Share. For Candidate Users, this is your personal biographical information in addition to information generated from the AJINGA assessments, that companies see about you. This may also include any other contributions you may have made to any community features AJINGA may offer. You have control over what you share, and you can update information at any time. For more information on your privacy options, visit section 3.B (Privacy Settings) of this Privacy Policy.

Communication. For Candidate Users, we help you communicate with potential organizations. Some of this communication is one-on-one, some of it is in groups, and some of it is through public discussion. You decide how much or how little you wish to communicate with potential organizations or other parties, whether that communication is one-on-one, in groups or through public discussions.

Private Activity. We also provide tools that you can use privately on AJINGA (for example managing your job applications, searching, or adding notes). These actions and information are private and we don't share or distribute them to other Users or third parties. Maintaining your trust is very important to us, so we adhere to the following principles to protect your privacy: We do not rent, sell, or otherwise illegally provide your personally identifiable information to third parties without your consent, except as described in this Privacy Policy or as required by law. We do not share any information you have not chosen to display on your AJINGA profile with other parties, except as described in this Privacy Policy or as required by law.
We reserve the right to modify this Privacy Policy at any time, effective upon its publication on www.ajinga.com If we make material changes to this Privacy Policy, we will notify you by means of a notice on our website so that you may access and review the changes to this Privacy Policy before you decide whether or not to continue to use of the AJINGA service. If you object to any changes in this Privacy Policy, you may close your account. By continuing to use the AJINGA service after notice of changes has been sent to you or published on the AJINGA website, you are consenting to the changes.

1. INFORMATION COLLECTED
The mission of AJINGA is to build China’s future by matching talent with opportunity. AJINGA is a platform that bridges the gap between organizations and prospects. We identify the unique individual capabilities in every candidate and match them to opportunities where they can excel. To achieve this mission, AJINGA makes features and functionality available through our website, our mobile applications and information provided as part of the services we make available through our website and our mobile applications (the “Services”) to enable candidates to create a profile, take assessments, research and compare opportunities, apply for positions, join networks, and share information. Our selection service includes both proactive applications and passive referrals. By joining AJINGA, you voluntarily and willingly provide AJINGA certain information, including personally identifiable information, which we collect in order to provide the Services. If you have any hesitation about providing information to us and/or having your information displayed on the AJINGA website, made accessible through the AJINGA mobile applications or otherwise used in any manner permitted in this Privacy Policy and the AJINGA User Agreement, you should not become a member of the AJINGA community; and, if you are already a member, you should close your account.

We collect your personal information in the following ways:

A. Registration
In order to become a Candidate User, you must provide us the following information to create an account: name, gender, email address, city, country, ID number and password. Without this minimal amount of information, you cannot create an AJINGA account. Like other passwords, you should choose one that is known only by you. You acknowledge that this information is personal to you, and by creating an account on AJINGA, you allow others, including AJINGA, to identify you and to allow AJINGA to use your information in accordance with our User Agreement and this Privacy Policy.

B. Contact Information
You may use the Services to send invitations to people you know if they have not registered with AJINGA. The names and email addresses of people whom you invite will be used to send your invitations and reminders as well as to allow AJINGA to help expand the AJINGA network. Please note that when you send an invitation that invitee will have access to your email address because it is displayed in the invitation. By providing email addresses or other information of non-Users to AJINGA, you represent that you have authority to do so. All information that you enter or upload about your contacts is covered by the User Agreement and this Privacy Policy and will enable us to provide customized services such as suggesting opportunities.

C. Profile Information
If you are a Candidate User, we encourage you to provide additional information to your AJINGA profile describing your skills, professional experiences, educational background and group memberships. Providing additional information about yourself beyond what is minimally required is entirely up to you, but providing additional information enables you to derive more benefit from AJINGA. Building your professional identity on AJINGA facilitates your search for new opportunities. Any information you provide may be used by AJINGA as described in the User Agreement and this Privacy Policy, including for the purpose of allowing opportunities to find you on AJINGA, or for serving more relevant advertisements on AJINGA. If you decide not to share certain information, you may not receive the full benefit of being an AJINGA User.

D. Talent Assessment
If you are a Candidate User, in order to successfully complete your profile you must complete the AJINGA assessment test. By completing the assessment test, you will learn more about what makes you unique and this information may help you make better choices about opportunity direction and potential organizations. The assessment test results may also help you to stand out from the crowd and increase your chances of obtaining engaging work and opportunities. You acknowledge that the information contained in an assessment report is personal to you, and by taking the assessment test you allow others, including AJINGA, to use your information in accordance with our User Agreement and this Privacy Policy. The assessment report does not represent AJINGA’s opinions or attitudes. Users have no right to file objections to, appeal from or otherwise make claims against AJINGA in connection with the results of an assessment test or the contents of an assessment report. You confirm that you will not file objections to, appeal from or otherwise make claims against AJINGA or any organizations because such organizations apply selection screening criteria, or make final selection decisions, based on the results set forth in the assessment report. If you disagree with the results of your assessment test or the contents of your assessment report, you may discontinue using AJINGA’s services and close your account.

E. Organization and Opportunity Profile
If you are an Organization User, in order to successfully complete an organization culture profile, you may be required to provide certain information about your organization, including the name, location, industry, and about the available opportunities including title, responsibilities, salary range and benefits. In addition, you may be given the opportunity to provide information about your organization culture, including by having current members complete an assessment test. By having current members complete an assessment test, you might learn more about what makes your organization unique and this information may help you make better choices about candidate selection direction and potential members. The assessment test results might also help you stand out from other organizations and increase your chances of obtaining the right members. You acknowledge that the information contained in the assessment tests is personal to your members, and by taking an assessment test, you and your members allow others, including AJINGA, to use your information in accordance with our User Agreement and this Privacy Policy. The assessment test results do not represent AJINGA’s opinions or attitudes. Users have no right to file objections to, appeal from or otherwise make claims against AJINGA in connection with the results of an assessment test or the contents of an assessment report. You confirm that you will not file objections to, appeal from or otherwise make claims against AJINGA or any past, present or potential members because such organizations make final selection decisions based on the results set forth in the assessment report. If you disagree with the results of your assessment test or the contents of your assessment report, you may discontinue using AJINGA’s services and close your account.

F. Customer Service
We collect information when you interact with AJINGA’s customer service website in order to accurately categorize and respond to customer inquiries and investigate breaches of the terms of our User Agreement and this Privacy Policy.

G. Using the AJINGA Website and Applications
We receive information when you interact with and use our website, our mobile applications and our platform technology. For example, we know when you apply for jobs, click on ads, upload your address book, join groups, participate in polls, or install an AJINGA mobile application.

H. Cookies
AJINGA may store so-called “cookies” on your computer or mobile device when you visit our website, register for any service and/or make enquiries. This allows us to recognize your computer, mobile device or any other device the next time you visit us. Most internet browsers are set to accept these cookies automatically and you, the User, may independently determine cookie use through adjusting your browser settings. The type of information AJINGA collects as a result of a cookie is specific to your computer or mobile device and may include the internet protocol (IP) address, the date and time you access our website or mobile applications and which parts of the website or mobile application you visit. The foregoing information is collected for the purposes of monitoring the usage and usefulness of our website and mobile applications, collecting statistical data and aiding us in sending you information suited to your interests about our company and our services. You may adjust your browser settings such that you will be notified when you receive a cookie and can opt to block or refuse such a cookie. However, please be informed that in doing so, you may be limiting your access to the Services.

I. Advertising and Web Beacons
To support the Services we may display our own ads and third-party ads both on and off our website and our mobile applications using ad networks. Ad networks include third party ad servers, ad agencies, ad exchanges, ad technology vendors and research firms. We may select ads for you based on your general profile information, on non-personally identifiable information inferred from your profile (e.g., industry, current or former company, school, compensation bracket, gender, age, or other aspects of your life), or on your use of AJINGA or your history of clicking through prior advertisements. AJINGA does not provide personally identifiable information to any third party ad network.

J. Rights to Access, Correct and Eliminate Information about You
You have a right to access, modify, correct and eliminate the data you supplied to AJINGA under sections 1.A (Registration), 1.B (Contact Information) and 1.C (Profile Information). If you update any of your information, we may keep a copy of the information that you originally provided to us in our archives for uses permitted by this Privacy Policy. You may request deletion of your information at any time by contacting AJINGA customer service. We will respond to your request within 30 days. Please note, however, that information you have shared with others, or that potential organizations have reviewed and copied, may remain visible even if you request its deletion.

K. Data Retention
AJINGA will retain your information for so long as your account is active or as needed to provide you the Services. If you wish to close your account, you may do so by sending an email with such request to service@ajinga.com We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our User Agreement.

2. USES OF PERSONAL INFORMATION
A. Consent to AJINGA Processing Information about You
If you are a Candidate User, the information you provide to AJINGA may reveal, or allow others to identify, your nationality, gender, age, AJINGA assessment profile results and other aspects of your life. By providing information to us for the purposes of creating a User account and completing your AJINGA profile, you are expressly and voluntarily accepting the terms and conditions of this Privacy Policy and the AJINGA User Agreement that allow AJINGA to process information about you. Supplying information to AJINGA, including any information deemed “sensitive” by applicable law, is entirely voluntary on your part. You have the right to withdraw your consent to AJINGA’s collection and processing of your information at any time, in accordance with the terms of this Privacy Policy and the User Agreement, by changing your privacy settings, or by closing your account. Your withdrawal of consent will not, however, have retroactive effect.

B. AJINGA Communications
As described in the User Agreement, we will communicate with you through email, notices posted on our website or made available through our mobile applications, messages sent to your AJINGA inbox, or through other means available through the Services from time to time, including mobile text messages. We may send you emails that help inform new Users about the features of the Services, and we may send you service messages relating to the functioning of the Services. We may also send you messages with promotional information directly or on behalf of our partners. If we send communications to you via a telephone carrier service with which you have a mobile communications subscription or otherwise have access, you understand that you are responsible for the payment of any service fees associated with your receipt of messages on your mobile device (including text message charges).

C. User Communications
Many communications you initiate through the Services (e.g., an invitation sent to a non-User) will list your primary email address and name in the header of the message. Your contact information will only be shared with another User if you have indicated that you would like to establish contact with that User.

D. Customized Content
We use information you provide to us (or to third parties with whom AJINGA offers combined services) to customize your experience on our website and our mobile applications. For example, when you login to your account, we may display the names of new organizations or opportunities or recent updates from companies you are following.

E. Sharing Information with Third Parties
AJINGA takes the privacy of our Users very seriously, and we do not sell, rent, or otherwise provide your personally identifiable information to third parties, except as described in this Privacy Policy. We will also not share other personal information not published to your profile or generated through engagement with other AJINGA services without your explicit consent or to carry out your instructions unless, disclosure is reasonably necessary in our opinion to: (1) comply with your consent; (2) comply with legal process, including, but not limited to, civil and criminal subpoenas, court orders or other compulsory disclosures; (3) enforce our User Agreement; (4) respond to claims of a violation of the rights of third parties, whether or not the third party is a User, individual, or government agency; (5) respond to customer service inquiries; or (6) protect the rights, property, or personal safety of AJINGA, our Users or the public. AJINGA offers a “public profile” feature that allows Users to publish portions of their AJINGA profile to the public internet. This public profile will be crawled by and displayed through search engines when someone searches for your name. You may opt-out of this feature by editing your account settings; however, AJINGA does not warrant how often third-party search engines will update their caches, which may contain old public profile information. We may provide aggregated anonymous statistics about the usage of the Services to third parties for purposes that we deem, in our sole discretion, to be appropriate, including to prospective advertisers on AJINGA.

F. Developers using AJINGA Platform Services
We may collaborate with and allow third parties to use AJINGA’s developer platform to offer services and functionality in conjunction with and outside of AJINGA. These third parties are “AJINGA Partners” with whom we have negotiated an agreement to provide services or developers who have agreed to our developer terms in order to build applications. The negotiated terms and conditions contain restrictions on access, storage and use of your information. If you choose to use the services of third parties you may be asked to confirm acceptance of the privacy policy and/or user agreement of the AJINGA Partners which have not necessarily been reviewed or approved by AJINGA. It is your choice whether or not to proceed under any third party terms, and once you do, the third party's terms, and not this policy, will govern how they handle information you provide to them directly or through your AJINGA account. Also, despite our agreements and technical steps taken to restrict access to and avoid possible misuse of information, we may not screen or audit all AJINGA Partners. We also cannot guarantee that any AJINGA Partner will abide by our agreement. You agree that your use of AJINGA Partners is on an “as is” basis and without any warranty from us. If you use any third party service of an AJINGA Partner, they may access and share certain information about you, such as non-public profile information. AJINGA is not responsible for your use of or inability to use any third party service including the content, accuracy, or reliability of applications and the privacy practices or other policies of AJINGA Partners.

G. Polls and Surveys
Polls and surveys may be conducted by AJINGA, AJINGA Users or third parties. As a User, you may be invited to participate in polls and surveys from our website our through our mobile applications. Your selection may be random, or it may be based on your non-personally identifiable information, such as job title, geography, company size and/or industry. Whether or not you decide to participate in a poll or survey is completely up to you. After you finish a poll or survey, you may be given access to the aggregate responses of the poll or survey on a results page. Some third parties may display advertisements on the results page based on your answers in the poll. In addition, AJINGA or third parties may follow up with you by email regarding your participation. We may use third parties to deliver incentives to you to participate in surveys or polls. If the delivery of incentives requires your contact information, you may be asked to provide personally identifiable information to the third party fulfilling the incentive offer, which will only be used for the purpose of delivering incentives and/or verifying your contact information. It is up to you whether you provide this information, or whether you desire to take advantage of an incentive. We will not disclose any personally identifiable information to any third parties in connection with the conduct of any polls or surveys. Your consent to use any personally identifiable information for the purposes set forth in the poll or survey will be explicitly requested by the party conducting the poll or survey. You may opt-out of participating in polls or surveys by changing your settings to stop receiving these inquiries and requests.

H. Search
We offer search services to help find information as well as opportunities. AJINGA search also allows Users to find opportunities, organizations, and contributions to the community aspects of the AJINGA Services, and helps Users more effectively use AJINGA and expand their network. We use information from User profiles and contributions to AJINGA groups to inform and refine our search service.

I. Answers, Groups, and other Services
If you post information in the forums or other public spaces of our website or our mobile applications, you should be aware that any personally identifiable information you choose to provide there can be read, collected, or used by other Users of these forums, as well as AJINGA Partners and other third parties, and could be used to send you unsolicited messages. AJINGA is not responsible for the information you choose to submit in these forums and other public spaces of our website or our mobile applications.

J. Testimonials Placed through AJINGA
If you provide any testimonials about the AJINGA Services, we may post those testimonials in connection with our promotion of our Services to third parties. Testimonials may include your name that you have provided.

K. Disclosures to Others as the Result of a Change in Control or Sale of AJINGA Corporation
We may also disclose your personal information and other information you provide to us as part of a sale of our assets, a subsidiary or division of AJINGA, or as the result of a change in control of AJINGA. Any third party that purchases AJINGA’s assets or otherwise acquires AJINGA or a relevant subsidiary or division of AJINGA, will have the right to continue to use the personal and other information that you provide to us.

3. YOUR INFORMATION CHOICES & PRIVACY SETTINGS
A. Accessing and Changing Your Account Information
You can review the personal information you provided to us and make any desired changes to the information you publish, or to the settings for your AJINGA account including your email and contact preferences, at any time by logging in to your account on the AJINGA website. Please be aware that even after your request for a change is processed, AJINGA may, for a time, retain residual information about you in its backup and/or archival copies of its database.

B. Privacy Settings
Because the mission of AJINGA is to connect talent with opportunity, we have established what we believe to be reasonable privacy settings that we have found most professionals desire. Because Users may use and interact with AJINGA in a variety of ways, and because those uses may change over time, we designed our settings to provide our Users with control over the information they share. We encourage our Users to review their account settings and adjust those settings in accordance with their preferences.

1. Open. The “open” privacy setting enables ANY AJINGA member employer to view your full information including your profile, your assessment results, and if you use our mobile application, your current physical location. Typically fresh graduates will set their profile to “Open”.

2. Semi Open. The “Semi Open” privacy setting enables ANY AJINGA member employer to view your partial, non-personally identifiable information. This information does NOT include your identity (name), contact information or assessment report. It will only include information about you which is required for determining whether there is a potential match between you and their opportunity. Such information may include your title, years of experience, university major, and if you use our mobile application, your current physical location. It will also include your generalized (but not specific) assessment information. In default mode you may choose to share your full information with an AJINGA member organization at any time, in one of three ways:

i. Application. By applying to a position with an AJINGA member organization, you grant access to that AJINGA member organization to view your full information, including your current physical location if you use our mobile application.

ii. Follow. By following an AJINGA member organization, you grant access to that AJINGA member organization to view your full information, including your current physical location if you use our mobile application.

iii. Grant Access. By accepting an invitation to apply or follow an AJINGA member organization, you grant access to that AJINGA member organization to view your full information, including your current physical location if you use our mobile application.

3. Private. In the “private” privacy setting mode, no AJINGA member organization will be able to see any part of your information. Note that when an AJINGA subscription member organization updates their system to indicate you are now employed by that organization, your account will automatically be set to “private” mode.

Organization Users that use our mobile applications and their members will be able to choose whether or not their current physical location is visible to other Users of the Services.

C. Closing Your Account
You can close your account through the AJINGA customer service site. If you close your AJINGA account, we will remove your name and other personally identifiable information from our publicly viewable database. If you close your account, we have no obligation to retain your information, and may delete any or all of your account information without liability. However, we may retain certain data contributed by you if AJINGA believes it may be necessary to prevent fraud or future abuse, or for legitimate business purposes, such as analysis of aggregated, non-personally identifiable data, account recovery, or if required by law. AJINGA may also retain and use your information if necessary to provide the Services to other Users. For example, just as an email you may send to another person through an email service provider resides in that person’s inbox even after you delete it from your sent files or close your account, emails you send through the Service to other Users, as well as your contributions to AJINGA answers or AJINGA groups, may remain visible to others after you have closed your account. Similarly, information you have shared with others, or that other Users have accessed while your account was active, may also remain visible. AJINGA disclaims any liability in relation to the deletion or retention (subject to the terms herein) of information or any obligation not to delete the information. AJINGA does not control when search engines update their cache, which may contain certain public profile information that has since been removed from AJINGA’s publicly viewable database.

D. Memorializing Accounts
If we learn that a User is deceased, we may memorialize the User’s account. In these cases we may restrict profile access, remove messaging functionality, and close an account if we receive a formal request from the User’s next of kin or other proper legal request to do so.

4. YOUR OBLIGATIONS
As a User, you have certain obligations to other Users. Some of these obligations are imposed by applicable law and regulations, and others have become commonplace in user-friendly communities of like-minded members such as AJINGA. You must, at all times, abide by the terms and conditions of the then-current Privacy Policy and User Agreement. This includes respecting all intellectual property rights that may belong to third parties (such as trademarks or photographs). You must not download or otherwise disseminate any information that may be deemed to be of a religious or political nature or content which may be injurious, violent, offensive, racist or xenophobic, or which may otherwise violate the purpose and spirit of the Service and its community of Users. You must not provide to AJINGA and/or other Users information that you believe might be injurious or detrimental to your person or to your professional or social status. You must keep your username and password confidential and not share it with others. Any violation of these guidelines may lead to the restriction, suspension or termination of your account at the sole discretion of AJINGA.

5. IMPORTANT INFORMATION
Changes to this Privacy Policy
We may update this Privacy Policy at any time. In the event there are significant changes in the way we treat your personally identifiable information, or in the Privacy Policy itself, we will display a notice on the AJINGA website, send you an email or notify you in through other means permitted by the User Agreement, so that you may review the changed terms prior to your continued use of the website or our mobile applications. If you object to any of the changes to this Privacy Policy, and you no longer wish to use AJINGA, you may close your account by contacting service@ajinga.com Unless stated otherwise, our current Privacy Policy applies to all information that AJINGA has about you and your account. Using the AJINGA Services after a notice of changes has been sent to you or published on our website shall constitute consent to the changed terms or practices.

6. SECURITY
In order to help secure your personal information, access to your data through the Services is password-protected, and sensitive data is protected by SSL encryption when it is exchanged between your web browser and the AJINGA website. To protect any data you store on our servers, we also regularly audits our system for possible vulnerabilities and attacks, and we use a tier-one secured-access data center. However, since the internet is not a 100% secure environment, we cannot ensure or warrant the security of any information you transmit to AJINGA. There is no guarantee that information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. It is your responsibility to protect the security of your login information. Please note that emails, instant messaging, and similar means of communication within AJINGA are not encrypted, and we strongly advise you not to communicate any confidential information through these means.
